Who is responsible for obtaining the DEC and advisory report?
Regulation 16(2) (as amended) states that ‘Except where regulation 18(3) applies, on and after 1 October 2008 every occupier of any building to which this regulation applies must:
(a) have in its possession or control at all times a valid advisory report; and (b) display at all times a valid display energy certificate in a prominent place clearly visible to the publicWhen are DECs required?
Regulation 16(2) (as amended) states that ‘on and after 1 October 2008 every occupier of any building to which this regulation applies must:
(a) have in its possession or control at all times a valid advisory report; and (b) display at all times a valid display energy certificate in a prominent place clearly visible to the publicWho should produce the DEC and advisory report and how?
Regulation 17(1)(d) states ‘a display energy certificate must be issued by an Energy Assessor who is accredited to produce display energy certificates for that category of building’; and regulation 19 states that ‘an advisory report is a report issued by an Energy Assessor after his assessment of the building …’. Part 5 of the Regulations contains detailed requirements for Energy Assessors. Regulation 25(1) requires that Energy Assessors ‘be a member of an accreditation scheme approved by the Secretary of State.’
Where are DECs to be displayed?
Regulation 16(2) (b) requires qualifying organisations to ‘display at all times a valid display energy certificate in a prominent place clearly visible to the public.’
